When a couple is planning marriage and there is a need for a pre-nuptial agreement, most people would handle that task in a similar way; the person with the higher assets hires a lawyer to prepare a draft proposal and the bargaining begins.
There is another way. Structure the task using two collaboratively trained attorneys, a neutral financial expert and a collaborative facilitator.
Begin with disclosures to the financial neutral (required for a valid agreement), discuss your goals and concerns with the collaborative facilitator. Consult with the attorney’s for needed advice and drafting of the final documents.
This approach would minimize the possibility of any resentment or hard feelings toward your, soon to be, spouse as you walk down the aisle.
